Scott W. Niemisto has experience on both sides of the courtroom, as a Massachusetts Defense Attorney and as a former prosecutor - working for both the Cape and the Islands District Attorney's office and the Suffolk County District Attorney's office. He knows the Massachusetts criminal court system in and out, and has the advantage of knowing how prosecutors are going to play their hand in court.

When it comes to plea bargaining, Attorney Niemisto's experience as a former Assistant District Attorney allows him to know when the right and wrong times are to negotiate your case with the prosecutor. When Attorney Niemisto feels it is the right time to talk to the ADA, he knows which charges the ADA would be more likely dismiss, and can get you the least punishment possible for the remaining charges.
Attorney Niemisto's experience also allows him to immediately identify those cases that motions to dismiss and suppress should be filed in, as well as those cases that must go to trial.
