Massachusetts Disorderly Conduct Defense Attorneys

Under Massachusetts law, if you cause a disturbance which creates a public hazard, and serves no legitimate purpose, you can be charged with a disorderly person offense, also known as disorderly conduct.

Massachusetts G.L. c. 272, ยง53 states how one, with the purpose of causing public inconvenience, annoyance or alarm, or recklessly creating a risk by engaging in fighting or threatening, or in a violent or tumultuous way, who creates a hazardous or physically offensive condition by an act that serves no legitimate purpose, has violated the statute.

Oftentimes, police officers will arrest a criminal defendant for three different charges:  (1) assault & battery on a police officer, (2) disorderly conduct, and (3) resisting arrest.  Referred to by our attorneys as "The Three-Pack," it's simply a way for law enforcement to stack the number of charges on each complaint, only to later provide the District Attorney with bargaining power during the plea bargaining process.

Most often, it boils down to the police feeling you are being disruptive or a nuisance to them.  If you annoy them for any reason, you could be arrested and charged - regardless of the legitimacy of the facts.
